General Terms and Conditions for Re-Image Effective date: December 3rd, 2024
These General Terms and Conditions (the "Terms"), together with the Service Level Agreement (the “SLA”), Privacy Policy, and Acceptable Use Policy, form the complete agreement (the “Agreement”) between Re-Image, a company registered in Australia with its office at 103 Osborne Drive, Mt Martha, Victoria, 3165 (hereinafter referred to as “Re-Image”), and the Client. These Terms govern the licensing and use of the Re-Image software solution (the “Solution”) and related services (the “Services”). Both Re-Image and the Client are collectively referred to as “Parties.”
The Solution provided by Re-Image is an image processing software designed for developers, web agencies, software companies, and businesses to resize, optimize, and deliver images in a format adapted for various devices. The Solution is offered by Re-Image as a Software-as-a-Service (SaaS) and can be accessed via the Re-Image website (the “Website”).
Any deviations from or additional terms to these Terms require written approval from Re-Image and apply solely to the specific Agreement without affecting any other agreement between the Parties.
Any terms proposed by the Client that are not expressly included in the Agreement are rejected and excluded from the contractual relationship between Re-Image and the Client.
In the event of a conflict between these Terms and other documents, the provisions of these Terms take precedence.
The Client subscribes to the Solution and Services through one of the following plans:
(i) Free Plan: No fees apply, and the Client receives limited support and service availability, as outlined in the SLA.
(ii) Plus Plan: The Client pays a monthly fee for a set amount of storage. The Client also receives full support and service availability as defined in the SLA.
(iii) Max Plan: The Client pays a monthly fee for a set amount of storage. The Client also receives full support and service availability as defined in the SLA.
To access the Services, Clients must create an account on the Website (the “Account”) and provide accurate, up-to-date information. Incomplete registrations will not be validated. The Client guarantees that all information provided is true and agrees to update any changes.
By clicking the acceptance button during account creation, the Client agrees to these Terms. Any conditional or partial acceptance of these Terms is null and void. Clients who do not accept these Terms cannot enter into an Agreement with Re-Image.
Subscriptions begin upon account registration and payment, lasting for an initial period of one month or one year, depending on the selected plan. Subscriptions automatically renew for the same duration unless canceled in writing by either Party: (i) by the last day of the current period for monthly subscriptions, or (ii) sixty days before the end of the period for annual subscriptions.
